1. Agreement to Terms
By accessing or using the Stranded Motorist Fund platform, including the website strandedmotoristfund.org (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and AiN Collective (“we,” “our,” or “us”). Stranded Motorist Fund is a registered trademark of Adam & Son LLC.
2. Description of Services
The Stranded Motorist Fund is a 501(c)(3) nonprofit “car bank” that provides emergency vehicle repairs and donated vehicles to individuals and families facing transportation crises.
Our Services enable:
- Individuals in need to apply for emergency vehicle-repair or vehicle-donation assistance
- Certified repair shops to perform approved repairs for program recipients
- Schools, dealers, and businesses to partner with the program
- Agency caseworkers to submit and track referrals on behalf of clients
- Donors and supporters to contribute to community transportation relief
3. Account Registration
To access certain features of our Services, you may need to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. User Conduct
When using our Services, you agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Submit false or misleading information
- Engage in fraudulent activities
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of our Services
- Use automated systems to access our Services without permission
- Collect user information without consent
5. Applicant Terms
If you apply for assistance, you additionally agree to provide accurate information in support of your application. An application must be on file before we can respond to requests for vehicle assistance. Assistance is subject to eligibility criteria, available funding, and program discretion; submitting an application does not guarantee assistance.
6. Partner Terms
If you register as a partner (repair shop, school, dealer, business, or referring agency), you additionally agree to:
- Provide accurate organizational information
- Maintain all necessary licenses, permits, and certifications
- Perform any approved work in accordance with agreed program standards
- Comply with all applicable consumer-protection and charitable-solicitation laws
7. Intellectual Property
The Services, including all content, features, and functionality, are owned by AiN Collective and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AiN COLLECTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
10. Indemnification
You agree to indemnify and hold harmless AiN Collective and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our program.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
